Australian Guide to Legal Citation 4th Edition

Guidance on using the Australian Guide to Legal Citation referencing style

Gazettes

Gazettes

See AGLC Part II — Domestic Sources > 3 Legislative Materials > rule 3.9.1

Use the following format to cite notices from government gazettes.

Jurisdiction, Gazette Title, No [Gazette Number], Full Date, Pinpoint.

Omit the pinpoint if not relevant. Where available, include the notice author and title at the start of the citation if there are multiple notices in that gazette or on the same page.

Examples

1 Commonwealth, Gazette: Special, No S 489, 1 December 2004.

2 'Australian Capital Territory Teaching Service' in Australian Capital Territory, Australian Capital Territory Gazette, No 1, 24 May 1989, 3.

Government orders and rulings

Orders and rulings of government instrumentalities and officers

See AGLC Part II — Domestic Sources > 3 Legislative Materials > rule 3.9.2

Only use the below format if the delegated legislation or gazette rules are not appropriate, eg use this format for Australian Taxation Office rulings and determinations.

Elements

Instrumentality/Officer, Instrument Title (Document Number, Full Date) Pinpoint
Australian Tax Office, Income Tax: Deductibility of Self-Education Expenses Incurred by an Individual (TR 2024/3, 21 February 2024) 14.
  • Instrumentality — add the abbreviated jurisdiction if appropriate
  • Officer — only include an officer's title not their name
  • Full date — the date the instrument takes effect.

Examples

3 Australian Taxation Office, Income Tax: Use of an Individual's Fame by Related Entities (TD 2023/4, 28 June 2023) 2 [10].

4 Minister for Immigration and Border Protection (Cth), Direction No 65: Visa Refusal and Cancellation under s501 and Revocation of a Mandatory Cancellation of a Visa under s501CA (22 December 2014).

Legislation delegated to non-government entities

Legislation delegated to non-government entities

See AGLC Part II — Domestic Sources > 3 Legislative Materials > rule 3.9.3

For consistency, format in line with AGLC rule 3.9.2 'Orders and Rulings of Government Instrumentalities and Officers' where possible.

Omit company status, eg Pty Ltd, and 'the' at the start of the issuing body's name.

The version date or effective date of the pinpoint reference may be used instead of the full date of effect if there is no document number or the document is frequently updated. Use the format:  Issuing Body, Title (at Full Date) Pinpoint.

Examples

5 Queensland Law Society, Australian Solicitors' Conduct Rules 2023 (at 27 September 2024) r 3.1.

6 Bar Association of Queensland, 2011 Barristers' Rule, as Amended (at 27 September 2024) r 14.

7 ASX, Listing Rules (at 5 June 2021) r 3.1.

Court Practice Directions and Notes

For court practice directions and notes not published in a law report series, use the below format:

Court, Practice Direction/Note Number/Identifier: Title of Practice Direction/Note, Full Date.
